The provider was out of compliance with rule R381-100-8(2)(d) by allowing individuals to be involved with child care in the program before receiving notification of eligibility from Office of Licensing. In the facility, one individual was counting in caregiver-to-child ratios before getting notification of clearance. Inspection: Unannounced, Annual Inspection. Correction status: Correction Verified. Correction action: On April 23, 2026, the licensor verified that another caregiver was able to take over caregiving duties and count in ratio until the employee received notification of clearance from the Office of Licensing as stated in rule.

R381-100-12(5)(a)-(f) — Interactions with children

The Licensee was out of compliance with R381-100-12(5)(a)-(f) by failing to ensure that interactions with children do not include any action that produces physical pain or discomfort. During the inspection, the licensor determined that a child had gloves taped to their hands to prevent them from continuing scratching other children. Inspection: Complaint, Investigation Inspection. Correction status: Correction Verified. Correction action: On April 22, 2025, the licensor verified that the Licensee revised policies and retrained staff to ensure interactions with children do not include any action that produces pain or discomfort, as required in rule.

R381-100-7(9)(a)-(g) — Caregiver requirements

The provider was out of compliance with rule R381-100-7(9)(c) by not ensuring that caregivers complete the preservice training offered by the department before caring for children. At the time of the inspection, there were two caregivers who had not completed preservice training and had been caring for children. Inspection: Unannounced, Annual Inspection. Correction status: Correction Verified. Correction action: On 3/12/2025, the licensor verified the caregivers completed the preservice training offered by the department as stated in rule.
