1240-04-01-.22 Specific Requirements for Child Care Centers

LC observed two different child being moved/shuffled from two different classrooms they were enrolled and assigned to other rooms to be in ratio versus an educator being added to the room. — Visit: QRIS Monitoring visit,Technical Assistance,Safety Plan Monitoring — Action taken: LC took another look at room ratios and was able to move the children back to thier original rooms. LC also discussed rules on shufling kids. LC also issued a violation for this.

LC was informed of an incident where a educator left the infant classroom leaving the room in a ratio of 1:8 that should have been 2:8. LC interviewed staff and Director and it was determined that this occurred. — Visit: Technical Assistance,Safety Plan Served,Complaint Investigation,Incident or Injury Investigation — Action taken: LC investigated the room being out of ratio and determined that the employee did leave. A ratio violation was cited and LC spoke with the Director and educator about ensuring educators know not to leave the room if ratio is affected.

LC observed educator with her back turned and bending over doing something for a few minutes while a table full of children ate snack. — Visit: Follow-up visit,Complaint Investigation,Safety Plan Monitoring — Action taken: LC immediately asked the supervisor to come sit with the children and explained to her she must be watching her at all times when they are eating.

1240-04-01-.09 Incident Reporting

An educator left a child outside last month and it was not reported to DHS or DCS. LC found out when a complaint was made about the center. Parents were not notified. — Visit: Follow-up visit,Complaint Investigation,Safety Plan Monitoring — Action taken: LC discussed with the Director why an incident report should have been made concerning this supervision lapse. LC issued a violation for incident reporting.

LC observed a classroom out of ratio. — Visit: Follow-up visit,Complaint Investigation,Safety Plan Monitoring — Action taken: LC observed a classroom being out of ratio and worked with the Director and Asst. Director to move a child from the room to try and get it in ratio. When the class was still out of ratio, a second educator was placed in the room. LC gave a violation for ratio during this visit and spoke with the educators and the director about students remaining in their assigned class and ensuring there are two teachers in this particular room.

1240-04-01-.11 Supervision

LC was in the classroom and a child crossed the threshold of the door and was attempting to walk into the next classroom. The educator was unaware the child was trying to leave the room until LC informed her. — Visit: Follow-up visit,Complaint Investigation,Safety Plan Monitoring — Action taken: LC was at the door when the child walked by and stopped the child to ask them where they are going. LC brought the child back in the room and made the teacher aware of what occurred. LC also spoke with the Director about the issue. The educator was sent home.

1240-04-01-.09 Incident Reporting

LC was made aware of an incident where an educator was rough with a child in the classroom and jerked them up with a fork in their mouth. DHS was not told, no DCS referral made, and parents were not notified. — Visit: Follow-up visit,Complaint Investigation,Safety Plan Monitoring — Action taken: LC investigated with SIU. LC spoke to Director about this concern. LC did an exclusion safety plan on this employee.

1240-04-01-.11 Supervision

LC interviewed Educator about reports that a child was left on the playground. The educator admitted not doing name to face outside prior to walking in the center and a child being left behind. Educator stated they did name to face inside and realized the child was left outside and saw them knocking on the door. — Visit: Follow-up visit,Complaint Investigation,Safety Plan Monitoring — Action taken: LC issued a violation for supervision and spoke with the Educator about the incident. LC asked the Director to make a incident report and get parents to sign this and place in the child's file.

1240-04-01-.09 Incident Reporting

Director did not notify the Department the same day that a complaint from a parent came in about an educator and the educator was fired. Director did not notify DCS of this complaint which would be considered suspected verbal abuse. Director did not report in the DHS portal an incident where a phsycial altercation occurred in the infant room between two employees and police were called. This phsycial altercation was also not reported to DCS. — Visit: Follow-up visit,Technical Assistance — Action taken: LC issued a violation of incident reporting to the center. LC explained incidents must be reported in the portal same day. Contacting LC is not incident reporting. LC explained that when in doubt or unsure to enter it in the portal. LC also informed Director that DCS should have been called after the physical altercation in the infant room because it potentially could have endagered the infants. LC also infomed the center that the employee who was accused of yelling at a child was DCS reportable offense.

1240-04-01-.11 Supervision

LC Weston observed educator with their back to a child still eating. Educator got up to help other toddlers wash their hands while one toddler was still seated and eating. Her back was turned for several minutes. Food was also left out after mealtime and not cleaned up. — Visit: QRIS Monitoring visit,Follow-up visit,Technical Assistance — Action taken: LC spoke with eductor during the mealtime to remind them of supervision rules they must follow during meals. LC suggested tips on how to manage the young class while still supervising them. LC also suggested to the Director to have a helper in younger classrooms to assist the educator. LC asked Director to review the mealtime supervision plan and to do observations during mealtime to see if staff is following the rules or needs reminders.

LC observed the Infant A room exceeding their maximum group size, having 9 infants in the room instead of their maximum group size of 8. The Three A classroom had a 27 month old child in a classroom with three years olds; under 30 months is not suppose to be combined. — Visit: Safety Plan Served,Technical Assistance,Safety Plan Monitoring — Action taken: LC discussed with Director what caused the classrooms to be out of ratio. Children were moved and ratios were corrected. Staff had received training on Adult/Child Ratio; LC and FS gave Director Further guidance on ratios and maximum group sizing. LC spoke with the Director and discussed strategies to implement to ensure classrooms are staying with their regulated adult/child ratios.

LC observed Classroom 3A was out of ratio by one student. The child was moved. Classroom 2a was out of ratio by 2 children. They were moved to another classroom. — Visit: QRIS Monitoring visit,Technical Assistance,Safety Plan Monitoring — Action taken: LC spoke with Director about ratios and gave extensive TA about tracking this and knowing ages by months so mistakes can be avoided. LC had Director move children out of the room to be in compliance with ratio. Two violations were served.

1240-04-01-.10 Duty to Report Child Abuse and Neglect

Employees and Director saw and witnessed possible abuse and neglect and failed to report to DCS and DHS. — Visit: Follow-up visit,Technical Assistance — Action taken: LC interviewed everyone with DCS and aske dfor Debby to remain on leave until the Safety Plan could be served for exclusion. LC will wait for DCS to close their case before closing this complaint. LC plans to issue a violation for failing to report to DCS prior to a parent reporting.

LC observed an infant being swaddled in the crib to sleep. Infants must have their arms free per safe sleep requirements. — Visit: Follow-up visit,Technical Assistance — Action taken: LC asked the educator to unswaddle the child. LC showed educator how to take the loose material and wrap around the infant with her arms out. LC spoke to the Director about this issue.

An infant was layed flat on the floor to hold and drink their bottle. LC informed the educator that the child needed to be held or placed in a high chair to drink their bottle. — Visit: Complaint Investigation,Technical Assistance — Action taken: LC discussed the violation with the Director and explained how the child should be sitting up or held. This was also discussed with the educator. LC suggested having CCR&R infant coach come in to work with infant teachers.

Allergy plan is incorrect after two QRIS visits. Two children with no medical documentation of an allergy have it marked they have EPI pens but no EPI pens present. LC asked for allergy list to be updated at the last visit and this was not completed. — Visit: QRIS Monitoring visit,Technical Assistance — Action taken: LC Ratliff observed the allergy plan with incorrect information two visits in a row. LC spoke with the Director about correcting this information and then posting throughout the center.

Mealtime supervison plan was not age appropriate for two visits in a row. This was discussed at the previous visit. -During observation an infant was layed flat on the floor to hold and drink their bottle. LC spoke with the educator and informed her this is against the rules and gave her infomation on how the child must be positioned to receive a bottle
