   The agency received violation TCA 71-3-508 due to noncompliance of the safety plan. Safety plan required training for all staff, specific trainings for Director, and specific trainings for owner all with required due dates. Not all trainings were completed within the required time frame. — Visit: Safety Plan Monitoring,Technical Assistance — Action taken: LC discussed with Director that they were receiving this violation due to training required by the safety plan not being met by the due date. LC also emailed General Manager to provide the same information.

   1240-04-01-.10 Duty to Report Child Abuse and Neglect

   During an investigation it was discovered that a child had expressed possible abuse. This is required to be reported immediately to DCS. After several attempts to obtain the DCS referral number LC cannot confirm that this was reported in a timely manner. — Visit: Complaint Investigation,Technical Assistance — Action taken: LC discussed with administration the importance of keeping the DCS referral number when you call in an incident so that LC has a way to confirm the referral has been made and can see the DCS determination.

   During a complaint investigation visit LC conducted a walkthrough of the playground as it was stated in the complaint that there were metal pipes on the playground that may be a hazard. LC did observe these metal pieces during walkthrough, and fall zone material did not meet 6 inch depth requirement. — Visit: Complaint Investigation,Technical Assistance — Action taken: LC discussed with Director and General Manager what was found on the playground. LC discussed with Director and General Manager that pre-play inspections and walkthroughs should be conducted each morning to ensure the playground is safe for the children. Fall zone surfaces should be maintained at a minimum of 6 inches in depth. General Manager stated that she was going to have the landlord of the property come out to fix the problem the afternoon of the visit.
