    On 1/13/26 Child # 1 was observed on video to be placing a vape to their mouth that fell out of a facility staff #1's pants pocket. The investigation was determined to be verified by a state police officer from Lehigh County investigating the complaint also. The state police determined the object fell out of facility staff # 1's pants pocket while they were sitting on the floor attending to another child. The state police conducted an intense video investigation and said the object was a vape. As soon as the state police notified the provider of their investigation, facility staff # 1 was terminated from the facility. Requirement: Cleaning materials and other toxic materials shall be kept in an area or container that is locked or made inaccessible to children. Correction: On January 16, 2026 a plan of supervision was put into place for the employee in question prior to this investigation. The plan of supervision included camera surveillance, constant supervision from qualified staff in the classroom environment, and frequent check-ins from administrative staff. The staff member was also not permitted to provide care in any of the infant/toddler classrooms. Staff # 1 was immediately terminated after another agency conducted their investigation. A policy memo to staff entitled Personal Belongings was issued on January 20th outlining personal items that are not permitted to be carried in order to remain safety focused while in the classroom. Lockers have always been provided for staff members personal belongings. Subsequently, on February 5, 2026 a similar memo to external personnel was issued outlining the same guidelines for personal belongings. The staff member's employment was terminated on March 2, 2026 when Officer Heffner notified Lehigh Children's Academy of the investigation and plans to pursue criminal charges against the employee. Outdoor play space used by the facility is considered part of the facility premises. Tiered IS 1. Children must be supervised at all times. This correction will be immediate. 2. The legal entity must arrange for all facility staff to receive a minimum of two hours of PQAS approved training regarding supervision of children. The legal entity must receive DHS approval of the training content prior to scheduling the training. Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises. The operator shall provide a date for when this training will be completed. Correction: This individual was put on administrative leave effective immediately and did not return to work.
