During the complaint investigation conducted on 11/27/2024 it was determined that staff person #1 smacked child #1 on the head with an open hand after picking him up by his arms from his rest equipment. Certification representative reviewed the video surveillance from the date 9/11/2024.Reviewed outside agency determination received on 1/29/25, and staff person #1 has been named as a perpetrator in an indicated report of child abuse. Requirement: A facility person who has been named as perpetrator in a founded/an indicated report of child abuse may not be present in the facility. During the complaint investigation conducted on 11/27/2024 it was determined that staff person #1 smacked child #1 on the head with an open hand after picking him up by his arms from his rest equipment. Certification representative reviewed the video surveillance from the date 9/11/2024. Requirement: A facility person may not use any form of physical punishment, including spanking a child. The legal entity must arrange for all facility staff to receive a minimum of two hours of training regarding supervision of children. The legal entity must develop a supervision policy which includes physical punishment of children. The legal entity must receive DHS approval of the policy content and training content prior to scheduling the training and reviewing the policy with staff. The policy will be reviewed by all staff. Staff will sign off on their understanding of the policy and place a copy of the policy in each individual staff person's file. Correction: All staff will complete supervision training on 2/22/2025 which includes physical punishment of a child. I will formulate a supervision policy to review with all staff. During the unannounced monitoring conducted on 11/27/2024 reviewed information obtained from the provider on 11/14/2024 when it was determined that staff person #2 was terminated from employment on 9/20/2024 when the provider observed video surveillance from 9/11/2024 of her smacking a child #1 on the head. Video surveillance was reviewed by certification representative. The provider stated that she did not report it right away due to the staff person becoming agitated while in the facility when she told her she was terminated. Requirement: An operator or a staff person who has reason to believe that a child enrolled in the facility has been abused is required to report suspected child abuse to ChildLine as mandated by the CPSL. A facility person who has reasonable cause to suspect that a child is a victim of child abuse shall immediately make a report of suspected child abuse to ChildLine through the hotline at 1(800) 932-0313, online, or any other method as prescribed by the Department. During the unannounced monitoring conducted on 11/27/2024 reviewed information obtained from the provider on 11/14/2024 when it was determined that staff person #2 was terminated from employment on 9/20/2024 when the provider observed video surveillance from 9/11/2024 of her smacking child #1 on the head. The provider stated that she did not report the incident to the child's parents. Requirement: A child's record must contain reports of accidents, injuries and illnesses involving a child in care at the facility. The original report shall be given to the parent on the day of the incident. The second copy of the report shall be retained at the facility in an accident file. The third copy of the report shall be retained at the facility in the child's file. Correction: On 11/21/2024 I informed the child's mother of the incident that occurred on 9/11/2024.
