A Complaint Investigation was conducted on 03/23/2026, during the investigation on 03/13/2026, Staff Person #1 was observed on camera grabbing Child #1 by the arm and pulling Child #1 with force into the indoor play space. Requirement: A facility person may not use any form of physical punishment, including spanking a child. Correction: Staff person #1 received a disciplinary action write up. Staff completed a training on Interactions Matter on Better Kid Care as well as a written summary of the training. Inspection: Complaints- Legal Location. At the time of the Renewal Inspection conducted on 03/11/2026, the file for Staff Person #2 did not contain verification of the completion of 12 clock hours of annual child care training. Requirement: A staff person shall obtain an annual minimum of 12 clock hours of child care training. Correction: Staff #2 took an additional 2hr training on Creating a space for Learning on Better Kid Care on 3/16/26 to satisfy 12 annual PD hours. Inspection: Renewal. At the time of the Renewal Inspection conducted on 03/11/2026, the most recent Health Assessment and Tuberculin skin test results on file for Staff Person #1, hired 02/12/2026, was dated 11/16/2024. Requirement: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis. Correction: The staff #1 received a new staff health assessment form on 3/16/26 as well as QuantiFERON-TB Gold Plus which is a type of IGRA on 3/15/26. At the time of the Renewal Inspection conducted on 03/11/2026, the most recent Health Assessment on file for Child #1 was dated 01/03/2025. Requirement: The operator shall require the parent to provide an updated health report at least every 12 months for an older toddler or preschool child. Outdoor equip.- protective surfacing (3270.102(c))

At the time of the Renewal Inspection conducted on 03/11/2026, The loose-fill surfacing under the embedded playground equipment is 6 inches deep and does not meet the requirements for protective surfacing. Requirement: Outdoor equipment that requires embedded mounting must be mounted over a loose-fill or unitary playground protective surface covering that meets the recommendations of the United States Consumer Product Safety Commission. The equipment must be anchored firmly and be in good repair. Correction: Facility Director has been notified and will order the loose fill to satisfy the requirement - A minimum of 12 inches (uncompressed) of loose-fill protective surfacing (such as wood mulch, sand, pea gravel, or rubber) is recommended under and around equipment. Building Surfaces (3270.76)

At the time of the Allocated Unannounced Inspection conducted on 08/14/2025, there were stained ceiling tiles in the Younger Toddler Classroom above the changing table. Requirement: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards. Supervised at all times (3270.113(a))

At the time of the Complaint Investigation conducted on 08/14/2025, the review of the video footage shows Staff Person #1 on their cell phone for five minutes, during which time adequate supervision was not being provided to the children in the classroom. Requirement: Children on the facility premises and on facility excursions off the premises shall be supervised by a staff person at all times. Outdoor play space used by the facility is considered part of the facility premises. 1. Children must be supervised at all times. 2. The legal entity must arrange for Staff Person #1 to receive a minimum of two hours of training regarding supervision of children. The legal entity must receive DHS approval of the training content prior to scheduling the training. Correction: 1. 09/05/2025- Children shall be supervised by staff person at all times while on the facility premises, during outdoor play, and on excursions off premises. Outdoor play space is considered off the premises. (Implemented 08/21/2025) 2. 09/19/2025- The legal entity will provide a DHS approved/required Two-Hour Supervision training. The operator shall complete and update the form and provide a copy to the family in accordance with the updates regarding emergency contact information in § 3270.124(f) (relating to emergency contact information). Building Surfaces (3270.76)

At the time of the Renewal Inspection on 03/20/2025, the grate on the bottom of the refrigerator located in Classroom 13 was missing and there was dust, dirt and food remnants under the refrigerator. Requirement: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards. Correction: The grate on the bottom of the refrigerator in room 13 was found on the side of the refrigerator in good condition. It was placed back to its place to keep the dirt out and stay clean. At the time of the Renewal Inspection on 03/20/2025, the temperature of the water from the sink in the Infant Room reached a temperature of 112.8° F. Requirement: Hot water temperature, in areas accessible to children, may not exceed 110° F. Correction: Play & Learn facility crew readjusted the water temperature in the Infant room and checked water temperature in all classrooms and areas where accessible to children to not exceed 110 F. Training regarding plan (3270.27(c))

At the time of the Unannounced visit on 12/23/2024, During nap time Staff Person #2 was observed working alone supervising 8 children ages 2-3 years old and Staff Person #3 was observed working alone supervising 10 children ages 4-5 years old. The file for Staff Person #1 and Staff Person #2 did not have verification of completion of Emergency Plan training. Requirement: The operator shall assure that each facility person receives training regarding the emergency plan at the time of initial employment, on an annual basis and at the time of each plan update. The operator shall document the date of each training and the names of all facility persons who received the training and kept on file at the facility. Correction: Staff #2 and Staff #3 received Emergency Plan training on site at the time of hire, but did not complete a form to verify the training. Staff #2 and Staff #3 signed the verification of the Emergency Plan training and will receive annual DHS Firesafety training/Emergency Preparedness Plan training and at the time of each update. 2 hour diaper check (3270.135(e))

At the time of the Complaint Investigation on 12/23/2024, it was determined that Staff Person #1 did not check the diaper of Child #1 every 2 hours or when the child indicated discomfort by exhibiting behavior that suggested a soiled diaper resulting in rash to the child. Requirement: A staff person shall check a child's diaper at least every 2 hours and whenever the child indicates discomfort or exhibits behavior that suggests a soiled diaper. A staff person shall change a child's diaper when the diaper is soiled. Correction: Staff #1 and all other staff were reminded of diapering requirement policy PA. Code 3270.135 with emphasis on: (b) Diaper changing surfaces shall be cleaned after each use by wiping the surface with a sanitizing solution or by changing a pad or other surface covering. (e) A staff person shall check a child's diaper at least every 2 hours and whenever the child indicates discomfort or exhibits behavior that suggests a soiled diaper. A staff person shall change a child's diaper when the diaper is soiled. All staff responded with their acknowledgement of the diapering requirements. Inspection: Complaints- Legal Location. At the time of the Unannounced visit on 12/23/2024, The file for Staff Person #1 contained a valid out of state ID for New Jersey, but did not contain out of state clearances. Requirement: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Facility Person # 1 may not work in a child care position at the facility. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #1- may not work in a child care position at the facility. Correction: Staff #1 was immediately removed from all childcare duties on site working with children. Staff #1 applied for clearances from State of New Jersey where she permanently resides for Child Abuse Registry, Criminal History Record, NSOR and FBI under CPSL Staff #1 received results from Criminal History, NSOR and has receipt from FBI fingerprint, registered and accepted notification from Child Abuse Registry and a copy of disclosure statement. The file for Staff Person #1 and Staff Person #2 did not have verification of completion of the required10-Hours CCDBG Health and Safety Training prior to working alone with children. Requirement: A facility shall be operated in conformity with applicable Federal and State laws and regulations.State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children.
