Immunization record/Dismissal policy (3280.131(d)(5)/3280.131(e)(3))

The immunization record of child #1 did not contain documentation of the 3rd DTaP and pneumococcal vaccinations and the record of child #2 did not contain documentation of the 4th pneumococcal vaccination as recommended by the ACIP or an acceptable exemption. Requirement: A health report shall include a review of the child's immunized status according to recommendations of the ACIP. The facility shall implement dismissal policies in accordance with the Department of Health regulation in 28 Pa. Code § 27.77 (relating to immunization requirements for children in child care group settings). Correction: Child #1 will be dismissed from care until an immunization record is on file that contains documentation of the 3rd DTaP and pneumococcal vaccinations (and child #2 does have a 4th pneumococcal on file) OR a note from the parents of child #1 stating they had personal reasons for not following the recommendations of the ACIP with the child's name, date of birth, missing vaccines, parent signature and date. The original financial agreement for child #1 was on file at the facility. Requirement: A parent shall receive the original agreement. The facility shall retain a copy of the agreement. Restraints prohibited (3280.113(e))

Upon arrival at approximately 10:05 AM, child #2 was observed to be sitting in a feeding table without any activities. When I inquired, staff #1 explained that the child had just eaten, and needed to remain seated for about 30 minutes to prevent illness. Shortly after, child #1 was provided with a puzzle. About 20 minutes later, the child was removed from the seat, only to be returned about 10 - 15 minutes later for lunch. Following the meal, the child remained in the table for approximately another 30 minutes before being moved to a pack and play for nap. Child #2 was observed to be in either the feeding table or pack and play for at approximately 1.75 hours of the 2.5 hours I was at the facility. Requirement: A facility person may not restrain a child by using bonds, ties or straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs. Correction: Child #2 will sit for 15 minutes after eating or drinking to prevent illness and offered a table activity while they are stationed at the table. After said time, child will be able to roam safely in the infant space. An infant that needs rest in the morning time will be limited or will be moved with their pack n play outside the infant play area. Inspection: Renewal. At approximately 10:10 am, child #1 was sleeping in a pack and play which was placed against the wall, about 12 inches from a "Cozy Coupe" child's car and about 5 inches from an exersaucer which did not allow for 2 feet of space on 3 sides of the pack and play. Requirement: At least 2 feet of space is required on three sides of a bed, cot, crib or other rest equipment while the equipment is in use. Correction: When child #1 is sleeping in her pack n play, it will be moved or toys will be moved to be sure there are 2 feet of space on 3 sides. Inspection: Renewal. The telephone numbers of the nearest hospital, police department, fire department, ambulance and poison control center was not posted by the 2 phones on the table. Requirement: The telephone number of the nearest hospital, police department, fire department, ambulance and poison control center shall be posted by each telephone in the facility. Correction: The telephone numbers to the nearest hospital, police department, fire department, ambulance, and poison control center will be written down or printed and taped to the back of the hand sets of the 2 phones for the facility. Comply with CPSL (3280.32(a))

The following clearances for staff #1 were updated more than 60 months apart: PA criminal history (5/8/2020 and 10/29/2025), child abuse (5/26/2020 and 10/30/2025), NSOR verification certificate (6/1/2020 and 10/31/2025) and FBI (4/28/2020 and 11/4/2025). Mandated reporter training for staff #1 was updated more than 60 months from the prior clearance (5/11/2020 and 10/29/2025). Requirement: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Pediatric first aid and CPR for staff #1 and #3 were renewed on 10/28/2025 which was after the expiration date of the prior training dated 9/2025. Requirement: Competence is the completion of training by a professional in the field of first-aid and CPR. All staff persons shall renew their certification in pediatric first-aid and pediatric cardiopulmonary resuscitation (CPR) on or before the expiration of the most current certification. The file of staff #1 and #2 contained 11 professional development hours in their annual training year of 12/2023 to 12/2024 each lacking 1 hour. Staff #1 had 2 additional hours dated 9/23/2025 and staff #2 had 2 additional hours dated 9/25/2025 and both are now compliant. Requirement: A staff person shall obtain an annual 12 clock hours of child care training. A facility person's record shall include verification of child care experience, education and training following the outset of service at the facility. Correction: The non compliance of 1 missing training hour for staff #1 has been taken from training hours dated 9/23/2025 and for staff #2 dated 9/25/25 and are now both compliant. The facility shall implement dismissal policies in accordance with the Department of Health regulation in 28 Pa. Code § 27.77 (relating to immunization requirements for children in child care group settings). Correction: Child #2 will be dismissed until missing immunizations listed above are obtained or until an exemption formed signed by the parents is on file. Inspection: Renewal. Based on a statement by a staff, 2 "bingo daubers" labeled "keep out of the reach of children" were used in an art activity with the children. Requirement: Arts and crafts materials shall be nontoxic. Correction: Art materials will be looked at more closely and not used if labeled " keep out of reach of children" and will be removed from the daycare area. Inspection: Renewal. On the table in the childcare space, 2 "bingo daubers" labeled "keep out of the reach of children" were accessible to the children in care. Requirement: Cleaning materials and other toxic materials shall be stored in an original labeled container or in a container that specifies the content. Toxics shall be kept in a locked area or in an area inaccessible to children, and shall be stored away from food, food preparation areas and child care spaces.
