Requirement: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards. During a complaint investigation on 5/9/25 based on staff interviews it was determined that that the provider was made aware of the incident Friday evening (4/25/25), viewed the video footage on Sunday (4/27/25), and did not report the incident to ChildLine until Monday (4/28/25), after advisement from the certification representative. Requirement: A facility person who has reasonable cause to suspect that a child is a victim of child abuse shall immediately make a report of suspected child abuse to ChildLine through the hotline at (800) 932-0313, online, or any other method as prescribed by the Department. Video footage provided by the operator, dated 4/25/25, contained the following: Staff person #1 was observed forcefully grabbing Child #1 by their upper arm, pulling the child up onto their feet out of their seat and escorted them to the carpet of "Home Living" space, separating them from the other children. Approximately ten minutes later, Child #2 walked over to Child #1 and the children began interacting. When Staff person #1 noticed, they were then observed to walk over to the children, bend over top of Child #2, grab their right bicep, and yank them away from Child #1. When Staff #1 moved Child #2 away from Child #1, Child #2's knees dragged on the carpet prior to getting onto their feet. Staff person #1 then walks Child #2 across the room while holding their right bicep up and arm above their head. Staff person #1 was then observed forcefully sitting Child #2 down by the arm onto the floor. Requirement: A facility person may not use any form of physical punishment, including spanking a child. Correction: A new diaper trash can was added to the classroom. The new diaper can is beside the room's changing table. Teachers were instructed to use this can moving forward for all diaper trash. At approximately 2:00pm in the Delaware Room, after an observed diaper change, Staff person #6 failed to wash the child's hands. Requirement: A staff person shall ensure that a child's hands are washed before meals and snacks, after toileting and after being diapered. Correction: All staff were reminded of the center's hand washing policy which includes washing children's hands after diapering the day of the inspection as well as presented with a handwashing slide on the staff meeting that was on 2/17/25. In the North Carolina Room, at approximately 11:42am, two infants were observed to be asleep in cribs that lacked 2 feet of space on three sides as evidence by both cribs were up against the wall and had 10 inches of space in-between them. Requirement: At least 2 feet of space is required on three sides of a bed, cot, crib or other rest equipment while the equipment is in use. Correction: Blue painter's tape was added to the floor in the crib area to outline crib placement to allow for the correct spacing in between cribs. In the Ohio Room two clear plastic toy bins containing toy trucks were observed to each have two cracked corners causing a potential pinch point and not be in good repair. In the California Room a clear plastic toy bin and an orange plastic toy bin were each observed to have cracks on the side and edges causing a potential pinch point and not be in good repair. Requirement: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts. The staff file for Staff person #2 who is functioning as an Assistant Group Supervisor, was observed to lack 2,500 hours of childcare experience; only 1,731 hours were documented. The staff file for Staff person #3 who is functioning as an Assistant Group Supervisor, was observed to lack two years of experience working with children. The staff file for Staff person #5, who is functioning as an assistant group supervisor, contained a foreign diploma that lacked additional documentation to show that the diploma had been evaluated to determine its validity and whether or not it meets qualifications for the position. Requirement: An assistant group supervisor shall have a high school diploma or a general educational development certificate and 2 years experience with children. A facility person's record shall include verification of child care experience, education and training prior to service at the facility. Correction: Staff person #2 has been moved to an aide position until verification of work hours have reached 2,500. Staff person # 3 has been reclassified to aide because of lack of childcare experience. Staff person #5's transcripts and diploma will be evaluated for validity by an accredited source (WES). The staff file for Staff person #2 and Staff person #3 was observed to contain a New Jersey Sex Offender check however there was no date on the check therefore it could not be determined if it was obtained prior to working with children as required by the CPSL. The staff file for Staff person #4 was observed to contain a Child Abuse clearance dated 9/30/24 on file which was not obtained prior to first date working with children. Requirement: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). LACKING REQUIRED HIRING DOCUMENTS: Staff Person #1-- may not work in a childcare position at the facility. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Staff Person #1 --- may not work in a childcare position at the facility. Correction: Staff person #1 will be removed from the classroom until the NSOR is obtained. The staff member called the clearance department to make sure that they received the clearance, and it will be sent out. Staff person #2 and Staff person # 3's New Jersey sex offender check has been dated with prior date. Staff person #4 has obtained clearances to work in the childcare center.
