Requirement: A facility shall be operated in conformity with applicable Federal and State laws and regulations.State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. During the renewal inspection, certification representative reviewed 10 staff files and the file for staff #1, staff #2, and staff #3 did not include an updated disclosure statement. Requirement: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). LACKING REQUIRED HIRING DOCUMENTS: Facility Person #1, 2 and #3 -- may not work in a childcare position at the facility. During the renewal inspection, certification representative reviewed 10 staff files and the file for staff #4 did not include an updated health assessment Requirement: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis. During the renewal inspection, certification representative reviewed 8 children files and the health reports for child #2 and child #3 did not include the statement that the child is able to participate in childcare and appears to be free from contagious or communicable disease. Requirement: A health report shall include a statement that the child is able to participate in child care and appears to be free from contagious or communicable disease. Correction: Provider will give the health report form to the parents of child #2 and child #3 to have their physician complete the form in its entirety. Inspection: Renewal. During the renewal inspection, certification representative reviewed 8 children's files and the file for child #1 did not include information regarding the child's special needs on the emergency contact form. Requirement: Emergency contact information must include information on the child's special needs, as specified by the child's parent, physician, physician's assistant or CRNP, which is needed in an emergency situation. Correction: Provider will have parents of child #1 completely fill out the emergency contact form that includes the information on the child's special needs, as specified by the child's parent, physician, physician's assistant or CRNP, which is needed in an emergency. Physician name, address, phone (3270.124(b)(2))

During the renewal inspection, certification representative reviewed 8 children's file and the files for child #1 did not include the phone number of the child's physician or source of medical care on the emergency contact form. Requirement: Emergency contact information must include the name, address and telephone number of the child's physician or source of medical care. Correction: Provider will get the phone number of the child's physician or source of medical care from the parents of child #1 and put it on the emergency contact form. Inspection: Renewal. No physical punishment (3270.113(b))

During the complaint investigation, certification representative viewed the facility cameras and seen staff #1 aggressively used physical punishment during naptime. Requirement: A facility person may not use any form of physical punishment, including spanking a child. Correction: Provider had called ChildLine and certification representative on Wednesday September 10, 2025, to report the suspected child abuse and at that time staff #1 was suspended. After observing the video footage on September 10, 2025, staff #1 was terminated from employment. Provider will retrain all staff on their Zero Tolerance Policy on September 23, 2025. Health and Safety Training (3270.31(f))

During the complaint investigation (EVE-00091453), certification representative reviewed 2 staff files and the file for staff #1 did not include the 10-hr. health and safety training with the 1hr update or the 10-hr health and safety revised or the 2-part 6 hr. health and safety per Announcement C-24-03 Health and Safety training. Requirement: Staff persons shall complete professional development within 90 days of hire as listed in subsections (f)1-10. Correction: Provider will have staff #1 trained in the 2-part 6 hr. health and safety training per Announcement C-24-03 Health and Safety training. Inspection: Allocated Unannounced Monitoring. No physical punishment (3270.113(b))

During the complaint investigation, certification representative viewed the facility cameras and seen staff #1 grabbed the child forcefully two times during naptime. Requirement: A facility person may not use any form of physical punishment, including spanking a child. Correction: Provider had called child line and certification representative on Tuesday May 13, 2025, to report the incident and at that time staff #1 was suspended. During the complaint investigation, certification representative reviewed facility files and video, on the video staff #1 had 4 infants in the evacuation crib and was given another child from another staff and placed in the evacuation crib which made staff #1 out of ratio. Infant: staff ratio 1:4 Requirement: When children are grouped in similar age levels, the following maximum child group sizes and ratios of staff persons apply: Infants 1:4 with a maximum group size of 8; Young toddlers 1:5 with a maximum group size of 10; Older toddlers 1:6 with a maximum group size of 12; Preschool children 1:10 with a maximum group size of 20; Young school-age children 1:12 with a maximum group size of 24; Older school-age children 1:15 with a maximum group size of 30. IF USING TIERED LIS: The required staff:child ratios must be maintained at all times. The legal entity must submit documentation in a format approved by DHS proving that the facility is maintaining the required staff:child ratios at all times. The legal entity will confirm continuing compliance by sending copies of the documentation to the -------- Region Office on a weekly basis for a period of three months after DHS approves the documentation format. Restraints prohibited (3270.113(e))

During the complaint investigation, certification representative reviewed facility files and video, on the video staff #1 was seen transporting 4 infants in an evacuation crib on the playground restricting their movements while talking to other staff members instead of engaging the children on the playground out of the evacuation crib. Requirement: A facility person may not restrain a child by using bonds, ties or straps to restrict a child's movement or by enclosing the child in a confined space, closet or locked room. The prohibition against restraining a child does not apply to the use of adaptive equipment prescribed for a child with special needs. Correction: Provider will ensure that staff #1 receive supervision training on topics pertaining to proper supervision and restraints via pakeys. Inspection: Complaints- Legal Location. Exceeding Capacity (3270.61(h))

At the time of renewal inspection at around 11 AM observed 10 preschool children in Room 202 with the established capacity of 7 and 9 young toddlers in Room 105 with the established capacity of 8. Number of children present in Room 202 and Room 105 exceeded capacity that was established. Requirement: The capacity established for an indoor space may not be exceeded. Correction: By March 31, 2025 we will have created another classroom to move around our classes to ensure proper capacities are followed. Room 105 students will be split in half and 5 young toddler students will be in room 105 and 5 in 202. The students in 202 will be moved to 110. Inspection: Renewal.
