Parent Access & Participation (3270.23)

On 11/13/25, staff #1 refused to release child #1 to the child's known parent despite the lack of any court documentation limiting the parental rights to access the child. Requirement: A parent of a child in care shall be permitted free access, without prior notice, throughout the center whenever children are in care, unless a court of competent jurisdiction has limited the parental right of access to the child and a copy of the order is on file at the facility. Opportunity shall be provided for parents to participate in the facility's program. The operator shall maintain a yearly file which documents general announcements to promote parent participation. The file shall be updated annually. Correction: I will notify any parent who has NA or left blank in the spot provided for parent that unless a court order is on file, the child can be released to the other parent. During the renewal inspection on 9/17/25, staff #1 had a mandated reporter training that does not meet the requirements and, therefore is not approved. Staff #2 did not have NSOR (see code sheet for start date). Staff #3 did not have required out of state clearances. Requirement: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #2 and #3 may not work in a child care position at the facility. Correction: Staff #1 completed correct mandated reporter training. Staff #2 has completed an NSOR. Building Surfaces (3270.76)

The wood on the half door to the 2nd room on the 2nd floor was split exposing screws. Requirement: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards. Devices must be compliant/Director or designated staff person ensure compliance (3270.95(a)/3270.95(b))

The fire alarm tests recorded were 7/24/25 and then 8/29/25, a period of greater than 30 days. Requirement: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. § 1016(c)). The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met. Correction: Fire alarms were tested the day of inspection on 9/17/25 and were all in working order. Another test and fire drill was conducted on 9/19/25. Inspection: Renewal. During an unannounced inspection on 3/6/25, there was cough syrup onsite for child #1 with an expiration date of 1/2025. Requirement: Medication shall be stored in accordance with the manufacturer's or health professional's instructions on the original label. Correction: Medication will be returned to parent. Pertinent Laws & Regulations/General Health and Safety (3270.14/3270.21)

As of the renewal inspection on 9/17/24, there was no continuity of operations plan as required by federal requirements at 45 CFR § 98.41(a)(1)(vii). Requirement: A facility shall be operated in conformity with applicable Federal and State laws and regulations.State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. Correction: A continuity of operations plan was written and inserted into the supporting documents of our emergency plan as attachment 6. Letter to parents (3270.27(e))

As of the renewal inspection on 9/17/24, the letter provided to parents regarding the emergency plan did not include information on lockdown procedures, or accommodations for infants, toddlers, children with special needs, or children with chronic medical conditions. Requirement: The operator shall provide to the parent of each enrolled child a letter explaining the emergency procedures. The operator shall also provide to the parent of each enrolled child a letter explaining any subsequent update to the plan. Correction: The emergency plan letter to parents has been updated to include lockdown procedures and accommodations for Infants and Toddlers. As of the renewal inspection on 9/17/24, the most recent clearances for staff #1 (State Police clearance dated 3/14/24, FBI dated 5/22/24) contained charges. The clearances and rap sheet had not been submitted to the NE Regional Office for review. Staff #1 must be supervised until notified by the regional office. Requirement: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). Correction: The PA Dept of Human Services clearance clearly stated that Staff #1 was approved to work in a childcare setting. All other pertinent information was collected by the certification representative on the day of the inspection. Staff #1 will be supervised at all times until clearance review results are obtained. As of the renewal inspection on 9/17/24, staff #2 had 2 written references, however one was written by her sister. Requirement: A facility person's record shall include two written, nonfamily references from individuals attesting to the person's suitability to serve as a facility person. Emergency plan (3270.27(a)(5))

As of the renewal inspection on 9/17/24, the emergency plan did not address accommodations for infants and toddlers, which are populations served at the facility. Requirement: The facility shall have an emergency plan that provides for accommodations for infants, toddlers, children with disabilities, and children with chronic medical conditions. Correction: Emergency Plan Supporting Documents have been updated to include Attachment 13 which contains a plan for accommodating Infants and Toddlers in an emergency evacuation. Availability of certificate of compliance and applicable regulations (3270.25(a))

As of the renewal inspection on 9/17/24, the operator had not provided the parent of each child enrolled with information on how to access the regulations in the chapter electronically. The posted regulations were incomplete. Requirement: The facility's current certificate of compliance shall be posted in a conspicuous location used by parents. The operator shall provide the parent of each child enrolled with information on how to access the regulations in this chapter electronically and with instructions for contacting the appropriate regional child care office. Correction: Information on how to access the regulations have been added to our Family Handbook. This includes a QR code that can be scanned by parents to access the regulations electronically.
