During the complaint investigation, certification representative interviewed staff and observed video footage of a child with a battery from a vape pen in the childcare space. Requirement: Ashes and cigarette or cigar butts are prohibited in a child care space, a play space or a food preparation area. Correction: Provider has addressed incident immediately by having staff remove the smoking paraphernalia out of the building, reported incident to human resources and gave staff #1 a written warning. During the complaint investigation, certification representative reviewed 11 staff files and the file for staff #1 (9/22/22) and staff #2 (1/18/23) did not include an updated health assessment. Requirement: A facility person providing direct care who comes into contact with the children or who works with food preparation shall have a health assessment conducted within 12 months prior to providing initial service in a child care setting and every 24 months thereafter. A health assessment is valid for 24 months following the date of signature, if the person does not contract a communicable disease or develop a medical problem. A facility person's record shall include a written report of initial and subsequent health assessments, including the results of initial and subsequent tuberculin skin tests, x-rays or other medical documentation necessary to confirm freedom from communicable tuberculosis. During the complaint investigation, certification representative reviewed 11 staff files and the file for staff #3 did not include the 1-hr health and safety training update that was due by December 30,2022 per Announcement C-22-06 that was issued on October 4,2022. Since the 1hr update isn't available staff will need to obtain the 2-part 6-hr Health and Safety training. Requirement: A facility shall be operated in conformity with applicable Federal and State laws and regulations.State agencies whose regulations may relate to the operation of a facility include the Department of Environmental Resources, the Department of Labor and Industry, the Department of Health, the Department of Education and the Department of Transportation. Conditions at the facility may not pose a threat to the health or safety of the children. Correction: Provider will have staff #3 obtain the 2-part 6-hr health and safety training and have them supervised until part-1 of the training is completed. No physical punishment (3270.113(b))

During the complaint investigation, certification representative viewed the facility cameras and seen staff #1 grabbed the child and forced moved the child from the cozy corner "blue carpet area" and forced the child into a chair. As the staff back was turned to the camera, I can see her hand go up then down in a striking motion to strike the child. Requirement: A facility person may not use any form of physical punishment, including spanking a child. Correction: Provider has suspended staff #1 with possible termination pending the investigation from facilities human resources. Provider will have all staff retrained and sign the code of conduct and keeping kids' safe policy. As of 9/4/2025 Laurie Roe was terminated. Inspection: Complaints- Legal Location. During an inspection on 11/15/24 the file for staff person #1 did not include verification of education. Requirement: A facility person's record shall include acceptable verification of experience, education or training is a transcript or a diploma or a letter signed by a representative of the experiential, educational or training entity. Correction: Staff Member 1 has reached out to her high school requesting them to send her transcripts and/or copy of diploma. Once received it will be entered into her file for licensing purposes. Staff person #1has not completed the following required pre-service training within 90 days of their date: pediatric first aid and pediatric cardiopulmonary resuscitation. Requirement: Staff persons shall complete professional development within 90 days of hire as listed in subsections (f)1-10. Staff persons shall complete professional development in pediatric first aid and pediatric cardiopulmonary resuscitation within 90 days of hire. Correction: Staff person #1 shall complete professional development in pediatric first aid and pediatric cardiopulmonary resuscitation. Staff person #1 will have until 1/8/25 to complete the required training. Until such time as the required training has been completed, staff person #1 must be supervised, when interacting with children, by an (AGS or GS) who has completed the required training related to this citation. During the renewal inspection, certification representative reviewed 3 staff files and the files for staff #1 is missing the NSOR clearance. Requirement: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). SAFETY PLAN: The operator is required to submit to the Children and Youth Agency a plan of supervision or alternate arrangement as required by the Child Protective Services Law. LACKING REQUIRED HIRING DOCUMENTS: Facility Person # -1may not work in a child care position at the facility. PROVISIONAL HIRE UNSUPERVISED: A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. Facility Person #-1 may not work in a child care position at the facility.
