Mail or deliver written report to regional office within 72 hours (3270.20(b))

A complaint investigation was conducted on 1/27/2026. The facility was notified on 12/22/2025 that Child #1 was taken to the emergency room for an incident that occurred at the facility on the same date. The facility did not submit a written report to the Northeast Regional Office within 72 hours of notification of the emergency room treatment. Requirement: The operator shall mail or deliver a written report to the appropriate regional office within 72 hours after hospitalization of a child in care, emergency room treatment of a child in care, death of a child in care, a facility fire requiring the services of a fire department. Correction: Form was submitted as soon as we were made aware of it on 1/27/26. Incident happened during pre-K counts hours under a PDE classroom. Email was sent to our former DHS inspector asking if we had to do anything further since it was a PDE classroom. No response received. Assumed nothing further was needed. An unannounced monitoring visit was conducted on 1/27/2026. At that time, facility's fire detection testing log was reviewed. Fire detection testing log showed that smoke alarms were tested past 30 days on the following occasions: 7/23/2025-9/15/2025 and 11/14/2025-12/17/2025. Requirement: Fire detection devices or systems must be in compliance with standards established under section 1016(c) of the act (62 P.S. § 1016(c)). The Director or designated staff person who is responsible for compliance with this chapter shall ensure the requirements under subsection (a) are met. Correction: Fire detection testing log is current. Additional fire drill will be done this week. Missed drill when center was closed in August for in-service preparing for a new school year. Staff person #1 did not update their NSOR clearance within 60 months. The original clearance was dated 12/19/19 and it was not updated until 1/3/25. Staff person #2 did not update their FBI clearance within 60 months. The original was dated 4/25/20 and it was not updated until 4/28/25 Requirement: The operator shall comply with the CPSL and with Chapter 3490 (relating to protective services). A provisional employee may not be permitted to work alone with children and must work within the vicinity of a permanent employee.A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL. The CPSL was revised on 9/18/2018 to include a requirement that all clearances be updated and on file at least every 60 months. The Child Protective Services Law (CPSL) was revised to include the requirement for the National Sex Offender Registry (NSOR) Clearance effective 9/30/2019. The CPSL also states that anyone hired after 9/30/19 was required to have the NSOR clearance to work in childcare. Current staff must have the NSOR clearance no later 7/1/20. CPSL was revised to include new hires that have resided out of Pennsylvania with in the 5 previous years must obtain State Police and Child abuse clearances from the state that they have resided. Correction: Clearances were received late due to agency failure to send out in a timely manner. NSOR was submitted in November. Agency follow up that they never received the request & the closed for holiday subsequently sending NSOR clearance upon returning from break. Clearance dated 1/3/25. Second staff appointment cancelled & rescheduled at another location with no notice. Fingerprint location closed a local site. FBI clearance dated 4/28/25, Inspection: Renewal.
