According to staff statements, staff person #1 was observed using harsh language towards multiple children, including yelling/screaming at children to follow directions. Requirement: A facility person may not use harsh, demeaning or abusive language in the presence of children. Correction: 4/17/26 Director reviewed agencies Megans Law Policy ED-03-121 with Bon Aire staff, on 5/14/26 & 5/18/26 all staff in agency were required to attend Mandatory Meeting which reviewed HS Program Performance Standard 1302.90, along with several of our agencies policies which included Standard of Conduct in Discipline, Positive Behavior Management and Guidance Policy ED-03-110, Safety of Children Policy ED-03-125, Crisis Plan ED-J3, Child Abuse Procedure ED-03-121. Agency will move from virtual child line training and information to an in person training and discussion platform on policies, being more in depth with staff on what is considered forms of physical punishment, self awareness, our agencies policies and expectations along with child line protocols and procedures starting in Aug for startup. No physical punishment (3270.113(b))

Based on staff statements and video observations, on 3-25-26, staff person #1 was observed using physical punishment with multiple older toddlers in room #2. Staff person #1 was observed forcefully yanking an older toddler's arm to pull them to get the child off the table they were standing on. Staff person #1 was observed dragging another older toddler, who was on their knees, by their hand/wrist multiple feet across the floor and lifting the child up off the ground by grabbing their arm above the elbow. Requirement: A facility person may not use any form of physical punishment, including spanking a child. The files for staff person #2, #3, and #5 had staff evaluations that exceeded 12 months between evaluations. Requirement: A director is responsible for written evaluation of staff persons on a regular basis, a minimum of one evaluation every 12 months. The files for staff person #1, #2, #3, #4, and #5 lacked current fire safety training completed within the last year. Requirement: Staff persons shall participate, at least annually, in fire safety training conducted by a fire protection professional. Staff persons and volunteers shall receive training in maintenance of smoke detectors, the duties of facility persons during a fire drill and during a fire and the use of the facility's fire extinguishers, not including discharge of the fire suppressant agent. The file for staff person #6, functioning as an aide, lacked verification of education to qualify as an aide. Building Surfaces (3270.76)

In room #1, there was 1 area on the wall where the contact paper was tearing and coming apart and was accessible to children. On playground B, there were 3 areas on the plastic trim around the mulch area that were cracked and had holes with sharp edges that were a visible hazard. Requirement: Floors, walls, ceilings and other surfaces, including the facility's outdoor play space surfaces shall be kept clean, in good repair and free from visible hazards. Correction: 3/3/26 room #1 covered the area where contact paper was tearing with updated yellow colored contact paper. On the outdoor infant/toddler play space, there were 2 areas of peeling paint on the window frame. Requirement: Peeled or damaged paint or damaged plaster is not permitted on indoor or outdoor surfaces in the child care facility. In room #3, there were 2 chairs with tears and holes in the fabric. Requirement: Toys, play equipment and other indoor and outdoor equipment used by the children shall be clean, in good repair and free from rough edges, sharp corners, pinch and crush points, splinters and exposed bolts. Correction: 3/3/2026 2 chairs with tears and holes in fabric were removed from the room during inspection and disposed later that day. Inspection: Renewal. In room #2, there was an infant observed sleeping in a crib that was not labeled with the child's name. A facility person's record shall include a copy of requests for the criminal history record and child abuse registry clearance information, a copy of the disclosure statement and a copy of the completed clearance information required under the CPSL.
