Evidence of violation: It was found during the unannounced visit conducted on 7/11/2025 that the Provider admitted to smoking during daycare hours. The Provider stated that she would go outside to smoke when the children were eating or napping for two quick puffs. The Provider stated she was in the process of quitting. For a violation of subsection 8 of North Dakota Century Code section 50-11.1-02, North Dakota Century Code section 50-11.1-02.2, section 75-03-08-04, subsection 4 or 11 of section 75-03-08-08.1, section 75-03-08-09, subsection 2 or 9 of section 75-03-08-14, section 75-03-08-23, or subsection 1 of section 75-03-08-24, within twenty-four hours. Method of correction: At this time, you are to make sure you are not smoking during daycare hours. Do move forward with making a plan as to what you will do to make sure this doesn't happen again. Evidence of violation: It was found that 3 school aged children (ages 8 and 2 11-year-olds) had gone to a local park by themselves without direct Supervision from the Provider. It was noted that the children were told by the Provider they could not go to the park on their own but were able to go there without the Provider noticing. Method of correction: At this time, you are to make a plan on how you will make sure this does not happen again. Do move forward with talking to your children so they know that they are part of the daycare and cannot go to the parks by themselves and that your daycare children cannot either and must have supervision at all times. Do write a plan in your response to ensure this does not happen agian. Fiscal sanction if not corrected: $5.00 per day. Time allowed for correction: 20 Day.
