   Correction order — Rule(s) 75-03-09-23.10 - A staff member, household member, or any other adult in or at the group child care may not kick, punch, spank, shake, pinch, bite, roughly handle, strike, mechanically restrain, or physically maltreat a child.

   Evidence of violation: While discussing a concern with the provider on 3/27/25 it was indicated that she has spanked her child in the bathroom at the child care program during child care hours. Method of correction: Refrain from inappropriate discipline during child care hours. Register for "Guiding Behavior: 10 Steps to Positive Discipline" on ND Growing Futures and complete in a reasonable amount of time. Please provide a copy of the registration to the licensing specialist within the 24 hour timeframe to complete this timely. Time allowed for correction: Immediate.    Correction order — Rule(s) 75-03-09-08. 1(i) - Ensure the group child care is sufficiently staffed at all times to meet the child and staff ratios for children in attendance and that no more children than the licensed capacity are served at any one time;

   Evidence of violation: A visit was conducted on 03/26/2025 at approximately 12:35pm. At the time of the visit there were 2 staff (representing 2.34 points) and 18 children (representing 3.30 points). The maximum points the 2 providers can care for is 2.34 points therefore the program is not in compliance. At the time of the visit several parents picked up their children to bring the program back into compliance. Method of correction: That the program is caring for no more than 2.34 points with 2 staff members. This was corrected onsite immediately with the licensing specialist present. It is encouraged that all staff are shown and are aware of the point system and what each staff and child present for points. Time allowed for correction: Immediate.
