   7.13(04)(j) — Transportation

   The field trip attendance form was reviewed. The attendance form had a place to sign children into the van from the program, then a place to sign the children back into the program after the field trip. The driver reported they do not sign children out of the van at the field trip site, then do a vehicle inspection. The van driver did report that moving forward they would sign children out of the van and do a post trip inspection, then sign children back into the van, then sign children out to the program and do another post trip inspection. Corrective action: The program administrator trained the drivers on how to properly fill out their drivers log and informed them that a post trip and pre trip inspection is very important every time a vehicle is used and when transporting children. Also informed the drivers children need to be signed in and out every time they enter and exit the vehicle, and the post trip needs to be done every time all students exit the vehicle. The program administrator will monitor all drivers logs at the end of the day to make sure everything is filled out properly. The transportation manager will also go over the driving logs at their next drivers meeting..    14.02 — BRC Information

   One van Driver had an expired BRC. The Licensor told the Program Administrator the Driver could not work with children until they have a current suitable BRC. Corrective action: The Driver was sent on July 17, 2025 to redo fingerprint for her BRC. The program is still waiting on the suitability. The driver was put on leave until we receive it. Moving forward the program administrator will schedule staff fingerprints and monitor the process. The staff/or driver will not be allowed to work until a suitability letter is received from the time it expired. The fingerprint appointments will be scheduled a month in advance. The program administrator will also monitor the BRC website on a daily basis.. Regulation: EEC’s BRC regulations are designed to ensure the completion of BRCs on individuals subject to EEC’s oversight, including those in receipt of federal Child Care Development Fund (CCDF) funding pursuant to the Child Care Development Block Grant (CCDBG) Act of 2014 at 42 USC § 9858 and funding through the Families First Prevention Services Act of 2017 at 42 USC § 471(a)(20)(D). Further, BRCs shall be performed in accordance with the statutory framework of M.G.L. c. 15D, §§ 7 and 8, 606 CMR 14.00 and consistent with the timelines established by EEC regulations or policy. EEC is responsible for reviewing all disqualifying information for candidates, with the exception of candidates for adoptive and foster parents to the extent authorized by the Federal Bureau of Investigations (FBI) and state statute. EEC may delegate to another Commonwealth entity its authority to complete BRCs through a Memorandum of Understanding or other applicable agreement to the extent permitted by state and federal law. While effective immediately, EEC will implement the provisions of 606 CMR 14.00 in phases and provide updated timetables for implementation within its written policies. Nothing in 606 CMR 14.00 shall be construed to create a private right of action if an EEC licensed, approved or funded program has acted in accordance with 606 CMR 14.00 and any policies adopted thereunder.    7.11(02)(e), 7.11(02)(c) — Health

   Two prescription medications reviewed were expired. Corrective action: The two prescriptions have been updated by the parents. The program was given new medication prescriptions for the students. Moving forward the site coordinators will be reminded monthly to check all medications for expirations. They will let the parents know and give them two weeks to update them. If they are not updated by that time the student will not be allowed to attend until we receive the updated medication. Regulation: Unless otherwise specified in a child’s individual health care plan, the educator must store all medications out of the reach of children and under proper conditions for sanitation, preservation, security and safety during the time the children are in care and during the transportation of children., All prescription medications must be in the containers in which they were originally dispensed and with their original labels affixed.    One van driver did not have current First Aid and CPR Certification. The Licensor told the Program Administrator the driver could not be alone with children, until they get their First Aid and CPR certification.
