K.A.R. 28-4-428a Education and training requirements. (b) (1) Each staff member who is counted in the staff-child ratio, each volunteer who is counted in the staff-child ratio, and each program director shall complete health and safety training either before employment or volunteering or not later than 30 calendar days after the date of employment or volunteering. Each staff member shall complete the training before being given sole responsiblity for the care and supervision of children.

(a) (1) Each individual caring for children shall be free from any physical, mental, or emotional conditions that prevent the individual's ability to protect the health, safety, and welfare of the children, shall be qualified by temperament and emotional maturity, demonstrate an understanding of children, and shall act with sound judgment.

Staff member in the infant unit was sitting in a rocking chair feeding a 3 month old infant. Staff got up to move another child from one area of the room to another. Staff put the three month old child against the side of her body, holding the child to her body by only one arm behind the child's back, causing the child to scream. Each refrigerator and each freezer shall contain a clearly visible, accurate thermometer.
