K.A.R. 28-4-116a Napping and sleeping. (b) (5) (F) The child shall sleep in a crib or a playpen that is free of any soft items, including pillows, quilts, blankets, bumpers, comforters, sheepskins, flat sheets, cloth diapers, bibs, stuffed animals, and toys.

On 10/28/2024, licensing specialists observed a six month old child sleeping with a blanket and a WUB-A-NUB pacifier which has a stuffed animal toy attached. (Complaint survey — To investigate a complaint — 24-008168)

K.A.R. 28-4-114(h), exceeding maximum group size. Licensee stated this occurred recently on a licensing visit which took place on 09/19/2024. Licensee did not provide licensing specialists with reasonable information regarding transportation. Licensee stated to licensing specialists during the visit on 10/10/2024, the facility did not transport children to or from school. During the second onsite visit on 10/28/2024, licensee informed licensing specialists she had regularly transported two children from school on multiple occasions over a two month period. K.A.R. 28-4-116a Napping and sleeping. (b) (5) (B) If the child falls asleep on a surface other than a crib or playpen, the child shall be moved to a crib or playpen.

K.A.R. 28-4-114a Initial and ongoing professional development training. (b) (2) Each provider shall complete the training before the date of employment or not later than 30 calendar days after the date of employment. Each provider shall complete the training before being given sole responsibility for the care and supervision of children.

Licensing specialists observed an individual being given the sole responsibility of caring for children on two occasions without completing health and safety training. Individual was hired more than 30 days ago. (Licensing survey — Compliance Check — 24-006162)

K.A.R. 28-4-125 Background checks. (a) (3) before allowing any individual to work, regularly volunteer, or reside in the facility and before allowing any individual whose activities involve either supervised or unsupervised access to children to be in the facility;

K.A.R. 28-4-126 Health of individuals at least 16 years of age. (a) (1) Each individual caring for children shall be free from any physical, mental, or emotional conditions that prevent the individual's ability to protect the health, safety, and welfare of the children, shall be qualified by temperament and emotional maturity, demonstrate an understanding of children, and shall act with sound judgment.

Provider did not demonstrate an understanding of children when the provider noted an eight month old infant was hungry. Provider began waving an empty bottle in the infant's face numerous times, taunting the infant while the infant fussed and reached for the bottle. (Licensing survey — Compliance Check — 24-006162)

K.A.R. 28-4-124 Parental permission for children to go off-premises. (b) Written permission on a form supplied by the department shall be obtained from the parent or legal guardian of each child who will be transported or allowed to participate in any off-premises field trip.
