K.A.R. 28-4-430 Health practices; illness and abuse; general health requirements for staff. (a) (5) Immunizations for each child in care shall be current as medically appropriate and shall be maintained current for protection from the diseases specified in K.A.R. 28-1-20(d). A record of each child's immunizations shall be obtained not later than 60 calendar days after the child's initial enrollment in a child care facility and shall be maintained on the child's medical record form.

One child's file out of eight reviewed did not have current immunizations on file. (Licensing survey — Annual Survey — 25-001961)

K.A.R. 28-4-423 Physical plant. (b) (6) Cold water and hot water shall be supplied to lavatory fixtures accessible to children. Hot water shall maintain a minimum temperature of 90 degrees Fahrenheit and shall not exceed 120 degrees Fahrenheit.

A faucet in the Preschool bathroom did not have hot water. Hot water did not come out. (Licensing survey — Annual Survey — 25-001961)

K.A.R. 28-4-132 Child care practices. (c) (1) (B) mental and emotional cruelty, including verbal abuse, threats, derogatory remarks about the child or the child's family, or statements which tend to shame, humiliate, or frighten the child;

Per collateral contacts staff were observed yelling at children using statements which tend to shame or humiliate children. Staff were heard yelling at children to "Get a grip" "you picked the wrong day" "I'm not doing this today" and "sit down on the carpet and be quiet". K.A.R. 28-4-132 Child care practices. (c) (1) (A) Corporal punishment, including hitting with the hand or any implement, slapping, swatting, shaking, pulling hair, yanking the arm, excessive exercise, exposure to extreme temperatures, and any other measure that produces physical pain or threatens the child's health or safety;
