The health assessment statement shall be documented on a form prescribed by the local licensing agency and updated at least every two years. 3.8.2 (A), Handbook: Unless statutorily exempted, all child care facilities must conform to state standards adopted by the State Fire Marshal, Chapter 69A-36, F.A.C., Uniform Standards for Life Safety and Fire Prevention in Child Care Facilities. A copy of the current and approved annual fire inspection report completed by a certified fire inspector must be on file with the licensing authority. The facility has not been inspected and approved by the local fire department as required. (Section 2.1(A) Health and Safety, Page 3) License/Certificates [SR] Comments: A fire inspection was conducted on 10/13/2025, however, there were several deficiencies identified and documented in the report. A follow up inspection is required to ensure that the noted areas have been corrected. Compliance Comments Fire drills were conducted monthly as required. Technical assistance was given to the provider to ensure practice drills are conducted with the facility's fire alarm. A follow up visit to observe a fire drill is required. 5.1(A), Handbook: A screening must be conducted as a condition of employment. Level 2 screening as outlined in s. 435.04, F.S., is required for all child care personnel and includes a criminal records check (both national and statewide), a sexual predator and sexual offender registry search, and child abuse and neglect history of any state in which an individual resided during the preceding 5 years. Documentation of Level 2 Clearinghouse screening clearance was missing for child care personnel. Staff Requirements [SR] Comments: During the course of a complaint inspection related to transportation, the following was observed; The van was observed pulling up to the school, dropping children off and leaving again. Some minutes later, the van came back with one additional child and the driver. No other staff member was in the vehicle. After speaking with the director, she stated that the driver is the son of a teacher that works at the school. He did the school a favor to transport the children but did not have a file and no proof of background screening. A class 1 non-compliance and Notice of Violation is being issued. 02. Sec. 7-45(b)(1), Ordinance: Vehicles must state the name of the child care facility on each side panel in six- to eight-inch letters. The back panel must have the wording Caution Transporting Children in a minimum of four-inch letters. The facilitys license number also must be printed on the side and back panels of the vehicle. The facility's vehicle(s) did not meet the requirement in that [previous owner's school name is still on the van]. Comments: The vehicle being used to transport children does not meet the vehicle signage requirement. A change of ownership was done at this facility in August 2025 and the name and license number of the new facility was not changed prior to transporting children. 3.8.2(B) and (C), Handbook: Fire extinguishers with a minimum rating of 2A:10BC must be properly installed, serviced and maintained with current inspection tags at all times. A fire extinguisher must be present in vehicles used to transport children and areas where food is prepared. The facility did not have a fire extinguisher with a current inspection in vehicles used to transport children. Children aged one through 3 years, such restraint device must be a separate carrier or a vehicle built-in child seat. Children aged 4 years, a separate carrier, a vehicle built-in child seat, or a child booster seat must be used with appropriate seat belt. Children aged 5 years and older must be in seat belts. The facility's use of seat belts and/or safety restraints was not age appropriate for children being transported. 2.5.2(F-G), Handbook: Upon arrival at the destination by vehicle, the driver of the vehicle must mark each child off the log as the child departs the vehicle; conduct a physical inspection and visual sweep of the vehicle interior to ensure that no child is left in the vehicle; and record, sign, and date the transportation log immediately, verifying that all children were accounted for, and that the visual sweep was conducted; ensure that a second child care personnel conducts a second visual sweep, signs and dates the transportation log verifying that all children were accounted for, and that the log is complete. If the provider contracts with an outside entity to provide transportation, then the provider must assign a child care personnel to perform the duties of the driver. Upon arrival at the destination by vehicle, a second and different child care personnel must conduct a physical inspection and visual sweep of the vehicle to ensure that no child is left in the vehicle; and sign, date and record the transportation log immediately, verifying that all children were accounted for, and that the log is complete. Procedures were not followed in that [a sweep was not conducted ]. Sec. 7-13(k)(1-5), Ordinance: Pursuant to Florida law, it is a misdemeanor of the first degree, punishable as provided in Section 775.082 or 775.083, Florida Statutes, for any person to knowingly: (1) Fail, by false statement, misrepresentation, impersonation, or other fraudulent means, to disclose in any application for voluntary or paid employment or for licensure regulated under Sections 402.301 - 402.318, Florida Statutes, all information required under those sections or a material fact pertinent to determination of such persons qualifications to be child care personnel, as defined in Section 402.302, Florida Statutes, in a child care facility, family child care home, or other child care arrangement. (2) Operate or attempt to operate a child care facility or family child care home without having obtained a license required by this chapter. (3) Operate or attempt to operate a child care facility or family child care home under a license that is suspended, revoked, or terminated. (4) Misrepresent, by action or omission, a child care facility or family child care home to be duly licensed pursuant to this chapter without being so licensed. (5) Make any other misrepresentations, by action or omission, regarding the licensure or operation of a child care facility or family day care home to a parent who has a child placed in the facility or home or who is inquiring as to placing a child in the facility or home, or to a representative of the local licensing agency, or to a representative of a law enforcement agency, including, but not limited to, any misrepresentation as to: a. The number of children at the child care facility or the family child care home; b. The part of the child care facility or family child care home designated for the provision of child care; c. The qualifications or credentials of child care personnel at the child care facility or home; d. Whether a child care facility or family child care home complies with the screening requirements of Section 402.305, Florida Statutes; or e. Whether the child care personnel have the training as required by Section 402.305, Florida Statutes. Child care personnel misrepresented information, impersonated, or provided fraudulent information related to the child care facility to a parent/guardian, licensing authority, or law enforcement. License/Certificates [SR] Comments: During the course of a complaint inspection regarding transportation, the following non-compliance was observed; The van was observed doing a drop off at 3:25PM. The driver unloaded the child and knocked on the entrance door. A teacher (V. D.) opened the door, took the child inside and closed the door. I asked the director for the transportation log for all the children that were transported into the facility. She responded that the owner was at the school earlier and he took the log with him. So I stated that i just saw one child get dropped off at 3:25PM and if she had a log for her to which she said no. I asked her to send me the transportation log she said the owner took with him. A transportation log was received that documented all the children who were transported, including the child that was transported at 3:25PM. The log had a signature on the driver and second person signature spaces. I had observed this child being dropped off and the driver and second person did not have a log nor conduct a sweep. 2.5, Handbook: Prior to transporting children, the facility must be approved by the Department to offer transportation services. The facility does not have approval for transportation services. Transportation must be discontinued until local licensing agency approval has been granted. License/Certificates [SR] Comments: A complaint allegation was received alleging that the school was suspected if providing transportation services without prior approval. FINDINGS: - The facility was licensed on 8/6/2025, and was not approved for transportation. The school was observed transporting children of ages 3 to 8 during today's visit. The vehicle being used has not been inspected and approved by child care licensing and fails to meet minimum licensing standards. There are transportation authorization forms on file for the children being transported. Provider was instructed to cease transportation services until it is approved by CCLE. 46.
