Sec. 402.305(4)(a), Florida Statutes: Minimum standards for the care of children in a licensed child care facility as established by rule of the department must include: 1. For children from birth through 1 year of age, there must be one child care personnel for every four children. 2. For children 1 year of age or older, but under 2 years of age, there must be one child care personnel for every six children. 3. For children 2 years of age or older, but under 3 years of age, there must be one child care personnel for every 11 children. 4. For children 3 years of age or older, but under 4 years of age, there must be one child care personnel for every 15 children. 5. For children 4 years of age or older, but under 5 years of age, there must be one child care personnel for every 20 children. 6. For children 5 years of age or older, there must be one child care personnel for every 25 children. A ratio of [2] child care personnel for [10] children is required. Ratios/Discipline [SR] Comments: At the time of inspection, the licensing monitor entered the building with one child care personnel. The director opened the door to allow both the licensing monitor and the staff member into the facility. During the walkthrough, the licensing monitor observed that the same staff member who had entered with them was now assigned to the 1 to 2s classroom, where another staff member was supervising ten children. The licensing monitor asked the director who was supervising the children at the time the director left the classroom to open the door and while the assigned teacher was outside the building. The director stated that she had been in the classroom but left to open the door, and that the assigned teacher had briefly left the facility to go to her house across the street. This resulted in the classroom being supervised by [1] child care personnel which does not meet required supervision standards. Following progressive enforcement procedures, a Notice of Violation is being issued as this standard was previously cited out of compliance on 2/25/26. Sec. 7-13(k)(1-5), Ordinance: Pursuant to Florida law, it is a misdemeanor of the first degree, punishable as provided in Section 775.082 or 775.083, Florida Statutes, for any person to knowingly: (1) Fail, by false statement, misrepresentation, impersonation, or other fraudulent means, to disclose in any application for voluntary or paid employment or for licensure regulated under Sections 402.301 - 402.318, Florida Statutes, all information required under those sections or a material fact pertinent to determination of such persons qualifications to be child care personnel, as defined in Section 402.302, Florida Statutes, in a child care facility, family child care home, or other child care arrangement. (2) Operate or attempt to operate a child care facility or family child care home without having obtained a license required by this chapter. (3) Operate or attempt to operate a child care facility or family child care home under a license that is suspended, revoked, or terminated. (4) Misrepresent, by action or omission, a child care facility or family child care home to be duly licensed pursuant to this chapter without being so licensed. (5) Make any other misrepresentations, by action or omission, regarding the licensure or operation of a child care facility or family day care home to a parent who has a child placed in the facility or home or who is inquiring as to placing a child in the facility or home, or to a representative of the local licensing agency, or to a representative of a law enforcement agency, including, but not limited to, any misrepresentation as to: a. The number of children at the child care facility or the family child care home; b. The part of the child care facility or family child care home designated for the provision of child care; c. The qualifications or credentials of child care personnel at the child care facility or home; d. Whether a child care facility or family child care home complies with the screening requirements of Section 402.305, Florida Statutes; or e. Whether the child care personnel have the training as required by Section 402.305, Florida Statutes. Child care personnel misrepresented information, impersonated, or provided fraudulent information related to the child care facility to a parent/guardian, licensing authority, or law enforcement. License/Certificates [SR] Comments: Child care personnel misrepresented information related to the Physicians Statement of Good Health for Child Care Center Personnel. This was done by copying blank health forms and manually entering staff information. Staff health records on file contained evidence of altered information, including the use of white-out and identical replicated markings across multiple forms. Additionally, the director provided the licensing monitor with both copies of the completed health forms and a blank form already signed by the physician. Effective immediately, all health records must be submitted in their original ink-to-paper form. Stamped, copied, scanned, or electronically reproduced documents will not be accepted. 4.1, Handbook: Child care personnel including volunteers who work 10 hours or more per month must successfully complete the departments training within 12 months from the date training begins. Training completion may not exceed 15 months from the date of employment in the child care industry in any licensed Florida child care facility. The facility did not have documentation of child care personnel's completion of required training on the training transcript in that [training incomplete]. Comments: At the time of inspection, licensing monitor observed [1] personnel who had not completed 40-hour training. Personnel initiated child care training in 2022 and has gaps in employment in the industry. Personnel training was not completed prior to re-joining the industry. Per provider, personnel reported that only exams were pending. Based on review of personnel DCF training transcript, all coursework has not been completed and no change to status of introductory training is observed after 2022. 04. 6.1.2(A) and (B), Handbook: Operators are required to notify the local county health department immediately upon any suspected outbreak of communicable disease and must follow the health departments direction. A suspected outbreak occurs when two or more children or child care personnel have the onset of similar signs or symptoms within a 72-hour period or when a case of a serious or reportable communicable disease is diagnosed or suspected in a child or employee. Some examples include shigella, salmonella, chicken pox, measles, pertussis, and hand, foot and mouth disease. The facility failed to report a suspected communicable disease outbreak for two or more children or adults within 72 hours to the local county health department and failed to follow directions given. (Section 2.1(A) Health and Safety, Page 3) Health Program [SR] Comments: At the time of inspection, licensing monitor arrived at the facility and was informed by provider via Ring Doorbell that facility was closed due to an outbreak of hand, foot, and mouth. Provider emailed two hours later to report the closure to the Department, stating that "50%" of the children were ill. Licensing monitor requested documentation to verify that the outbreak was properly reported to the health department. Provider stated, "parents took them to the doctor and stated that its the hand and foot virus." Provider failed to report the suspected outbreak to the health department.
