The health assessment statement shall be documented on a form prescribed by the local licensing agency and updated at least every two years. 6.4 (A), (C) and (D), Handbook: All accidents and incidents or unusual occurrences that are threatening to the health, safety, or welfare of a child that occur while the child is in care must be documented on the same day they occur. Documentation must include the name of the affected party, date and time of the occurrence, description of the occurrence, actions taken and by whom, and appropriate signatures of program child care personnel and the custodial parent or legal guardian. Program child care personnel signatures may include the director/child care personnel that witnessed the incident, who were involved in the incident, and/or responded to the child's needs. The documentation must be maintained for 12 months. An accident/incident report was not written, complete and/or maintained. Childrens Records [SR] Comments: Complaint alleges that program did not make notification that child JL had bit other children on "multiple occasions." Complaint alleges that child injured lip on "Friday" and an incident report was not issued. FINDINGS A statement was received from the owner RM. RM states that JL bit other children "two or three times" before verbal parent notification was made to JL's parent because JL was new to the facility and they were informed by parent that JL has exceptionalities. RM was attempting to work with JL to identify a pattern to the behavior before making parent notification. No supporting documentation of exceptionality was provided at enrollment. RM states the parents of children who were bitten were made aware of the incidents, but incident reports were not generated because the bites didn't "break the skin" and the parents allegedly stated it wasn't a "big deal." RM states injury to the lip did occur at pickup on 11/03 and in view of the authorized pickup that day. An incident report was created, but the authorized pickup declined the report allegedly stating, "mom will take it tomorrow." The following day, the report was not mentioned by parent or RM. Video footage was not made available because the hard drive was being replaced at the time of parent request for footage. This complaint regarding incident report for lip injury is unsubstantiated. Incident reports are not required for the aggressor. However, non- compliance is issued as incident reports are required for the victims of biting. 41. 3.1(A), Handbook: All child care facilities must be clean, in good repair, free from health and safety hazards and from evidence of, or presence of, vermin infestation. An area(s) of the facility was observed to not be in good repair. Facility/Storage [SR] Comments: At the time of previous inspection, licensing monitor observed a stained ceiling tile in the bathroom of Room 3. At the time of reinspection, the tile is stained. Per provider the tile was replaced and was stained again due to condensation. At the time of reinspection, Room 5 is being utilized as storage. The room is locked, rendering the usable floor space (including [2] toilets and [1] sink required for capacity) inaccessible to children in care. [1] water fountain is also inaccessible. Per Quality Assurance Specialist, this room may be removed from the licensed capacity. Overall capacity may be reduced from 80 to 56. It is noted that room was out of compliance during a routine inspection on 06/26/2024 under standard 18-03 (usable indoor floor space). A reinspection was completed in cooperation with the Quality Assurance Specialist on 07/31/2024. Technical assistance regarding general facility cleaning and maintenance has been previously provided by licensing monitor and Quality Assurance Specialist.
