The entrance into the home smelled of cigarette smoke. Caregiver started smoking in the garage and failed to use the exhaust fans to prevent smoke from entering the home. Regulation: Smoking is prohibited in a child care home and a child care group home while children are in care. AS 47.32.140(b) - Centralized Licensing and Related Administrative Procedures.Purpose and applicability.
As evidenced by the entity failing to cure violations from a Plan of Correction dated November 4, 2021, stating the violation would be cured and will not recur when smoking was occurring today in the garage and the exhaust fan was not in use to prevent smoke from entering the child care area. Regulation: An entity receiving a notice under (a) of this section, or a notice under AS 47.32.130(b)(2) that contains the information specified in AS 47.32.130(b)(2)(B), shall submit a plan of correction to the applicable department for approval. Once it has cured its violations, the entity shall submit to that department an allegation of compliance. Upon receipt of the allegation of compliance, the applicable department may conduct a follow-up investigation or inspection to determine compliance. The department that provides notice of a violation may take one or more enforcement actions under (d) and (f) of this section regardless of whether the entity achieves compliance under this subsection.
