7 AAC 10.1040(a)(1) - General cleaning and sanitation standards.

The entity did not clean or sanitize table the before serving food to children. 7 AAC 10.1035(a)(14) - Premises.

Children's sleep mats had no space between to ensure two feet of sleeping space separating each mat/cot Regulation: An entity shall ensure that at least two feet of floor space are provided between each crib, mat, or bed. AS 47.32.140(b) - Centralized Licensing and Related Administrative Procedures.Purpose and applicability.

The entity did not cure or ensure violations will not recur as stated in the Plan of Correction for the Report for Inspection/Notice of Violation dated March 12, 2025 that was submitted to the Department and approved on May 30, 2025; for the Report of Inspection/Notice of Violation dated January 8, 2024 that was submitted to the Department and approved on February 22, 2024; for the Report of Inspection/Notice of Violation dated on July 17, 2024 that was submitted to the Department and approved on August 20, 2024; Repeat violations include: the area designated for child care had stacked boxes baskets, and overflowing materials stacked on the floor and table, reducing usable space. Children's emergency record cards were not reviewed and updated at least semi-annually. The entity failed to ensure that the table is cleaned and sanitized after each use when a table used for snack was not sanitized after each use. The entity failed to ensure that insects, rodents, and other pests are controlled, and that the entity is kept free of conditions that are likely to attract or harbor pests when around and inside the bathroom sink cabinet located in the toilet area had multiple rodent droppings as well as droppings that were on toy shelves and areas where napping mats/cots were located. This is a repeat violation from March 12, 2025, July 17, 2024, and January 8, 2024. Regulation: An entity receiving a notice under (a) of this section, or a notice under AS 47.32.130(b)(2) that contains the information specified in AS 47.32.130(b)(2)(B), shall submit a plan of correction to the applicable department for approval. Once it has cured its violations, the entity shall submit to that department an allegation of compliance. Upon receipt of the allegation of compliance, the applicable department may conduct a follow-up investigation or inspection to determine compliance. The department that provides notice of a violation may take one or more enforcement actions under (d) and (f) of this section regardless of whether the entity achieves compliance under this subsection. 7 AAC 10.1060(g)(2) - Additional provisions for entities licensed to provide care for children.

A child was observed to pick up a toy, put it in their mouth and drop on the floor without an administrator separating the toy to be cleaned for later. 7 AAC 10.1060(g)(1) - Additional provisions for entities licensed to provide care for children.

Toys were kept on the floor and shelves that were surrounded by mice droppings and a children's toy phone was noticeably soiled and visibly dirty. 7 AAC 10.1045(5)(A) - Universal precautions.

The caregiver did not encourage children to wash hands before eating snack, nor did children wash hands before sitting on the floor and eating a large muffin. Regulation: An entity shall take precautions to reduce risk against the spread of a communicable, contagious, or infectious disease that could pose a significant threat to the health, safety, or welfare of adults or children in care. 7 AAC 57.630(d)(3) - Equipment and supplies.

Clean and sanitary blankets were not provided to each child when mouse droppings fell to the floor when a child's rumpled blanket was shaken. 7 AAC 10.1065(c)(1) - Food service and preparation.

The entity failed to ensure the proper care of sanitary food preparations when drinking water, cups, and utensils were stored in the bathroom sink and, on the bathroom sink counter; alongside the the toilet bowl brush. Additionally, the entity failed to maintain sanitary conditions of the refrigerator used for child care food when the refrigerator had dried spills, food, and stains. Regulation: An entity that is exempt under 18 AAC 31.012 or 18 AAC 31.014 from the requirements of 18 AAC 31 shall maintain sanitary facilities for the proper care, storage, refrigeration, and preparation of food. 7 AAC 10.1040(a)(3) - General cleaning and sanitation standards.

The waste receptacle in the bathroom was noticeably soiled and grimy. The entity failed to maintain sanitary conditions of the refrigerator used for child care food. 7 AAC 57.300(b)(2) - Qualifications of an administrator.

The administrator allowed children in care to discipline other children in care, stating that's just what (s)he does and not recognize her own role in teaching children how to appropriately engage with one another or taking lead on behavior guidance. 7 AAC 57.400(a)(3) - Admission and planning for care.

Facility failed to maintain the child's emergency information at least semi-annually. This is a repeat violation from January 8, 2024, June 2023, and March 18, 2018. Regulation: A child care facility shall review and update information obtained under (1) of this subsection at least semi-annually, or more often if a parent provides changed or additional information. 7 AAC 10.1030(e)(1) - Toilet facilities, sinks, showers, and bathing facilities.

The entity failed to ensure hand washing soap was available at the bathroom sink. Additionally, the entity used the bathroom sink to wash utensils and materials used for food, with dish washing soap in bathroom nest to a toilet bowl brush that was placed on the sink counter. This is a repeat violation from July 17, 2024. Regulation: Except for an assisted living home providing service for two or fewer residents, the entity shall ensure that each handsink is used only for its designated purpose and is equipped with soap and at least one accessible single-use towel dispenser or heated air hand-drying device; the entity shall ensure that towels are discarded after each use; Cited at a unannounced Investigation inspection. 7 AAC 10.1035(a)(2) - Premises.

A hazard existed when a stairway and door leading to the second door exit was blocked with a clutter of boxes, food, and stored items beginning on each stair leading upwards, and narrowing the walkway up the stairs to then fully block the second door exit. 7 AAC 10.1040(a)(2) - General cleaning and sanitation standards.

The entity failed to ensure that uncarpeted floors, rugs, doors and other surfaces often touched are clean when rodent excrement visible throughout the facility, rugs are dirty and stained, when rubber floor mats were stained and dirty, and when there was grime build up on doors, walls, and the floor around the bathroom garbage. Regulation: Except as provided in (b) of this section, in addition to the other cleaning and sanitation requirements of 7 AAC 10.1000 - 7 AAC 10.1095, an entity shall ensure that ; uncarpeted floors, low shelves, walls, door knobs, and other surfaces often touched by adults or children in care are cleaned and sanitized at a frequency to keep the surfaces clean and sanitary; in each carpeted area, the entity shall ensure that the carpet is vacuumed and shampooed at a frequency to keep it clean; Cited at a unannounced Investigation inspection. 7 AAC 10.1050(c)(1) - Caregiver Hygiene

Caregiver did not thoroughly wash her own hands before preparing and serving food to children. 7 AAC 10.1060(a)(1) - Additional provisions for entities licensed to provide care for children.

The entity did not use the safety gate to block the entrance to the stairs when a toddler was in care. This is a repeat violation from March 12, 2025. 7 AAC 10.1095(a)(1)(B) - Toxic substances; poisonous plants.

The entity failed to ensure that plants, cleaning material, a toilet cleaning brush placed on bathroom sink, grooming products, various oils, paint, old food, containers with unrecognizable liquids were all accessible to children. This is a repeat violation from March 12, 2025 and January 8, 2024. Regulation: An entity shall ensure that each cleaning material, detergent, aerosol can, pesticide, poison, and other toxic material is inaccessible to children or to adults with impaired judgment, and stored separately from medication and food; Cited at a unannounced Investigation inspection. 7 AAC 57.300(b)(1) - Qualifications of an administrator.

The administrator provided children with a medicine bottle with a child-proof lid containing as small toy inside as shaker toy, stating the bottle is "red and pretty, not recognizing the potential danger that this was teaching children that medicine bottles are play objects. 7 AAC 10.1035(a)(3) - Premises.

The entity failed to ensure that the entity is kept free of conditions that attract rodents when food, unsanitary conditions, exterior and interior holes for rodents to enter, and rodent excrement are visibly noticeable throughout the facility. This is a repeat violation from January 8, 2024. Regulation: An entity shall ensure that insects, rodents, and other pests are controlled and that the entity is kept free of conditions that are likely to attract or harbor pests; any pesticide use is subject to the notice and other applicable requirements of 7 AAC 10.1093; if the department determines that the entity is not adequately controlling pests, the department may require the administrator to hire a commercial pest control applicator certified under 18 AAC 90, or to take other appropriate action if a commercial pest control applicator is not available in the community; Cited at a unannounced Investigation inspection. 7 AAC 57.535(d)(4) - Behavior guidance.

Children in care were subject to discipline by other children in care when one older child was heard to count, "1-2-3," in a disciplinary tone regarding other children's behavior. The same older child was observed telling another child to report to (the older child) on the behavior of a third child. The younger children listened to and followed the orders of the older child, and the administrator took no action to intervene or stop the older child's disciplinary behavior. 7 AAC 57.350(f) - Orientation and Training

The administrator did not receive at least 24 hours of annual training relevant to child care and development, at least one hour must address a health and safety training topic in (a)(4) of this section based on the individuals hire date with the facility. Regulation: Except as provided in the training requirements of 7 AAC 57.300 for the administrator, a child care center, child care group home, or child care home shall ensure that each administrator, and caregiver receives at least 24 hours of annual training relevant to child care and development. At least one hour of annual training must address a health and safety training topic in (a)(4) of this section based on the individual's hire date with the facility. Except as provided in (j) of this section, the 24 hours of annual training must be in addition to the orientation and training required under (a) of this section and the training in first aid and CPR required under (e) of this section. An administrator or caregiver may satisfy the annual training requirements of this subsection by obtaining college credit relevant to child care and development if the department approves the credit.
