7 AAC 10.1090(a) - Animals.

There were two dogs and one cat on the premises with no documentation of immunizations records. 7 AAC 10.1015(b)(1)(B) - Heating and heating devices.

The baseboard cover was missing from a heating element, exposing the metal fins within. AS 47.32.140(b) - Centralized Licensing and Related Administrative Procedures.Purpose and applicability.

The entity did not cure or ensure violations will not recur as stated in the Plan of Correction for the Report of Inspections/Notice of Violation dated April 11, 2024 that was submitted to the Department and approved on June 3, 2024. There were visible food spills, dried food, and food debris present inside and outside the refrigerator and freezer, training documents were not maintained for the administrator and caregiver, and a caregiver attendance record was not created and maintained. In addition, the entity did not cure or ensure violations will not recur as stated in the Plan of Correction for the Report of Investigation/Notice of Violation dated May 11, 2023 that was submitted to the Department and approved on July 25, 2023 when there were two dogs on the premises with no documentation of immunizations records and parents of enrolled children and the department were not notified of animals present in the entity. Regulation: An entity receiving a notice under (a) of this section, or a notice under AS 47.32.130(b)(2) that contains the information specified in AS 47.32.130(b)(2)(B), shall submit a plan of correction to the applicable department for approval. Once it has cured its violations, the entity shall submit to that department an allegation of compliance. Upon receipt of the allegation of compliance, the applicable department may conduct a follow-up investigation or inspection to determine compliance. The department that provides notice of a violation may take one or more enforcement actions under (d) and (f) of this section regardless of whether the entity achieves compliance under this subsection. 7 AAC 57.630(a)(4) - Equipment and supplies.

Materials and supplies were haphazardly stacked in bins and baskets which were then stacked on top of one another above counter height. In one area they were stacked to the ceiling. The stacked bins and baskets lined the walls of the play area. The materials and toys were not arranged in a way that makes them accessible to children. The shelves in a closet that was accessible to children was stacked with linens and other objects that had potential to fall out and onto a child. Regulation: A child care facility shall select equipment and supplies to support facility programs so that the amount, variety, arrangement, and use of materials, toys, and equipment available when stored, are stored safely, with at least some of the toys and materials still accessible to children. 7 AAC 57.620(g)(5) - Space.

The area designated and approved for child care had stacked boxes, baskets, and tubs of overflowing materials which were stacked on the floor reducing usable space for children. There was not adequate open floor space for infants to explore safely and freely, to crawl, stand, and learn to walk. 7 AAC 10.1065(c)(1) - Food service and preparation.

There were visible food spills, dried food, and food debris present inside and outside the refrigerator and freezer. Additionally, a plate of dried Spaghetti-o’s was sitting on top of the fish tank, a partially eaten sandwich was observed on a shelf under the television, and there was an unlabeled plastic container of leftover food. Regulation: An entity that is exempt under 18 AAC 31.012 or 18 AAC 31.014 from the requirements of 18 AAC 31 shall maintain sanitary facilities for the proper care, storage, refrigeration, and preparation of food. 7 AAC 57.350(f) - Orientation and Training

Documentation that the administrator and caregiver received at least 24 hours of annual training, one hour of which is on one of the health and safety training topics identified in this section, was not available to demonstrate compliance. This is a repeat violation for the same caregiver noted on the April 11, 2024, Report of Inspection/Notice of Violation. Regulation: Except as provided in the training requirements of 7 AAC 57.300 for the administrator, a child care center, child care group home, or child care home shall ensure that each administrator, and caregiver receives at least 24 hours of annual training relevant to child care and development. At least one hour of annual training must address a health and safety training topic in (a)(4) of this section based on the individual's hire date with the facility. Except as provided in (j) of this section, the 24 hours of annual training must be in addition to the orientation and training required under (a) of this section and the training in first aid and CPR required under (e) of this section. An administrator or caregiver may satisfy the annual training requirements of this subsection by obtaining college credit relevant to child care and development if the department approves the credit.
