   7 AAC 57.535(b) - Behavior guidance.

   Positive reinforcement, redirection, and the setting of clear and consistent limits did not occur from caregivers, rather a culture of impatience and intolerance was observed regarding undesirable behaviors from children. Two children were the focus of the caregivers' attention as caregivers were observed pushing, pulling, and wrestling children to gain compliance, especially when dressing in snow clothes or forcefully attempting to have children participate caregiver-facilitated activities. Verbal tone and volume of caregivers was elevated and reflected anger and a high degree of annoyance. Children were threatened with future punishment for currently occurring behaviors with the possibility of having to stand against the fence during outside time. Regulation: A child care facility shall provide for positive reinforcement, redirection, and the setting of realistic expectations and clear and consistent limits.    Both caregivers consistently used their own bodies i.e. arms, legs, and torso to physically restrain and prevent children from movement. Both caregivers physically wrestled children to the floor in attempt to force children into snowsuits. Caregiver A cornered a child behind a door and grabbed at the child. Caregiver B squeezed a child's head between her own thighs to restrain child from movement as caregiver B tried to force child's feet into snowsuit. Regulation: A child in care may not be physically restrained, except when necessary to protect a young child from accident, to protect persons on the premises from physical injury, or to protect property from serious damage; and then only passive physical restraint may be used; Cited at a unannounced Investigation inspection.    7 AAC 57.535(e) - Behavior guidance.

   There was no written plan of care in place, developed with the parents to provide support for two children whose behaviors were the primary focus of negative attention from the caregivers. Regulation: In a child care facility, when a child has a pattern of out-of-control behavior, the child may be removed from the company of other children until the child's behavior has stabilized. Exclusionary practices are only to be used as a last resort in extraordinary circumstances where there is a serious safety concern that cannot be reduced or eliminated with reasonable accommodations. In addition, the child care facility shall develop a written plan with the child's parent to provide individualized social and emotional intervention supports for the child while the child is in care. The plan must include methods for understanding the child's behavior, and developing, adopting, and implementing a team-based positive behavior support plan with the intent to reduce challenging behavior and prevent suspensions and expulsions.
