746.1605(1) - Child/Caregiver Ratio - 18 Months Difference in Age

There was a 16-month-old infant and a 17-month-old infant napping in a classroom with children that were more than 18 months older than the two infants. The oldest child in the group was 4 years old. This exceeded the 18 month age difference allowed between the oldest and youngest child in the group. (Note: This was corrected during the inspection when the two infants were moved to the infant classroom with another caregiver).

746.1201(4) - AP Responsibilities of Employees and Caregivers -Ensure No Child Abused, Neglected, or Exploited

The findings of a DFPS Investigation resulted in a caregiver being found ?Reason to Believe? for neglectful supervision after a child wandered away from the daycare premises unattended and was found crossing a busy street.

745.8411(a) - Responsibilities - Not interfere with an inspection or investigation

Based on the information obtained during a DFPS investigation, it was found that the former director hindered the investigation by attempting to cover up that a child wandered off-premises unsupervised. The former director intentionally misled investigators by falsely claiming the child did not belong to their center.

746.701(5) - Licensing Incident/Illness Report Form - Situations Placing Children at Risk

Based on information obtained during a DFPS investigation, it was found that an incident report was not completed and shared with the parent when their child was placed at risk.

746.307(b)(4) - Parental Communication - Situation that Placed a Child at Risk

Based on information obtained during a DFPS investigation, it was determined that the child's parent was not notified of an incident that placed their child at risk of harm.

746.1003(1) - Director Responsibilities - Operate in Compliance

Due to the numerous deficiencies cited, the former director did not ensure the operation was operating in compliance with the minimum standards. The former director?s failure to adhere to safety protocols during transitions, and their failure to enforce these protocols amongst staff, directly resulted in a child being left unsupervised. The former director knowingly provided false information and withheld pertinent details regarding an incident that placed a child at risk.

746.1205(a)(4) - Supervision ensures each child?s safety, well-being, including physical proximity and auditory or visual awareness of each child?s on going activity

Based on information obtained during a DFPS investigation, it was determined that a child, left unsupervised on the playground, wandered off the property and was discovered by a passerby crossing a high-traffic road.

746.1201(1) - Responsibilities of Employees and Caregivers -Demonstrate Competency, Good Judgment, Self-control

Based on information obtained during a DFPS investigation, it was determined that a caregiver did not demonstrate good judgement and competency when neglecting to perform the required name-to-face check when transitioning. This resulted in a child being left unsupervised on the playground. The caregiver was no aware that the child was not with the group.

746.305(a)(6) - Report Situation Placing Children at Risk

The operation failed to notify Child Care Regulation of a serious incident that placed a child at risk.

746.631(a) - Sign-in and Sign-out Tracking System

Based on the preponderance of evidence relating to the DFPS investigation, there was no documentation that the child was signed out of the daycare.

746.1201(1) - Responsibilities of Employees and Caregivers -Demonstrate Competency, Good Judgment, Self-control

Based on the preponderance of evidence relating to the DFPS investigation, the caregiver did not use good judgement when she did not follow policy and procedures and dropped a child off at the wrong school.

746.603(b) - Children's Records - Storage

According to the DFPS investigation notes, the operation admitted to the DFPS investigator that they threw away the old transportation logs before the three months had expired.

746.5617(a)(1) - Required Equipment in Vehicles - List of Children

Based on the preponderance of evidence relating to the DGPS investigation, the operation did not have a current list of children being transported which resulted in a child being dropped off at the wrong school.

746.4751(b) - Maintenance Procedures for Active Play - Monthly Maintenance Checklist

I observe a broken sand box cover that had a crack in the middle which exposed rigid edges. I observed a piece of plastic debris and a broken cylinder toy that was broken as well in the toy box outside. This was corrected during the inspection when the director removed these broken/damaged items and put them in the trash.

746.2421(b) - Written Feeding Instructions - Review and Update Every 30 Days

There were 5 infants who's written feeding instructions had not been updated or signed by parents within the past 30 days.

746.603(a)(4) - Children's Records - Immunizations

7 children out of the 10 records reviewed did not have up to date immunization records avaialble in their files for review during the inspection.

746.1301(a)(3)(A) - Training Requirements for Employees, Caregivers, and Directors - Pediatric First Aid with Rescue Breathing

One caregiver did not have their pediatric first aid training certificate available for review during the inspection.

746.1601 - Child/ Caregiver Ratio - 13 or More Children

One caregiver in a classroom with a specified age-group of 2-years-old was caring for 12 children, making this classroom over ratio. This was corrected at inspection when the director moved the youngest child (20 months old) to the infant classroom, making both classrooms in ratio.

746.1301(a)(4)(A) - Training Requirements for Employees, Caregivers, and Directors - Pediatric CPR

One caregiver's current pediatric CPR training certificate was unavailable for review during the inspection.
