746.307(b)(4) - Parental Communication - Situation that Placed a Child at Risk

During the investigation it was learned that the operation failed to ensure the parent was timely informed of all known information regarding a situation that placed a child at risk. Although management later identified possible causes of the injury through video review, including a block striking incident and a slip-and-fall, this information was not promptly communicated to the parent.

746.701(5) - Licensing Incident/Illness Report Form - Situations Placing Children at Risk

During the investigation it was discovered that the operation failed to accurately document all known information regarding a situation that placed a child at risk. After management reviewed video footage and identified additional events that may have contributed to the child?s injury, the incident report did not initially reflect those findings and required revision. Therefore, the Licensing Incident/Illness Report Form was incomplete and did not accurately document the circumstances known to the operation.

746.1013(a)(3) - Director's Absence - Caregiver in Charge Has Access to All Records

The assistant directors did not have access to their personnel files in the absence of the director for CCR Inspector to review.

746.4103(c) - Policies for Release of Children Instruct Employees of Verification Plan

Based on information provided throughout the investigation, it was found that the operation did not follow their written operational polices for the release of children. Per the operational policies the operation must receive written consent for a child to be released to someone other than their parent.

746.1203(3)(C) - Janitorial duties

During the review of the video footage, the teacher was focused on picking up toys, this can take away from the teacher?s ability to adequately supervise children.

746.1201(1) - Responsibilities of Employees and Caregivers -Demonstrate Competency, Good Judgment, Self-control

Based on the information obtained during the investigation it was found that a caregiver grabbed a child by the arm and forcefully sat him in a chair twice while she was cleaning the classroom. The operation also allowed a person whose behavior presented a safety risk to children into the classroom.

A child's admission form did not include release information. The admission form is blank under the release authorization.

The operation was cited due to lack of supervision during a transition period which they admitted to leaving a child behind in a classroom unattended.

During the investigation staff did not know the children they were responsible for.

746.2805(3) - Prohibited Punishments - Grabbing and Pulling

According to DFPS investigation findings video footage was reviewed and showed caregiver grabbing a child by the arm.
