The investigation found that a caregiver was redirecting a child and the child tripped, and the caregiver did not console the child afterwards.

Based on the evidence gathered during the investigation, it was determined a caregiver abruptly moved a nap cot while a child was on it.

746.5605(4) - AP Safety Precautions for Loading and Unloading Children - No Child Unattended

A child was left unsupervised on the bus.

746.5625(d)(2) - Electronic Child Safety Alarm - Driver or designated employee conduct walk-through and visual check of vehicle

A walk-through of the bus was not completed after the children unloaded. Children often disable the bus alarm at the back door of the bus.

746.5625(b) - Electronic Child Safety Alarm - installed and maintained according to manufacturer's instructions

During the DFPS investigation, it was determined that the bus alarm sometimes malfunctions.

This standard was reviewed in relation to the reported allegations and found to be deficient. A name to face account of the children was not completed by the caregiver before returning inside and closing the door and this resulted in a child being left unsupervised.

746.3703(a) - People Whose Behavior/Health Threatens Children Not Present

The director did not intervene to prevent potential risk to children when there were previous concerns about a caregiver possessing vape products on site.

746.3703(d) - No Smoking or Use of Tobacco Including E-Cigarettes or Vaporizers

A caregiver staff had a vape pen and other paraphernalia on property while children were present.

746.3819 - Food Allergy Emergency Plan Signed by Parents and Health Care Professional

A caregiver provided a child with food containing egg products, despite a known and serious allergy. CI: This was corrected and resolved when the operation had a food allergy emergency plan signed by the child's parent within his file and as well in his classroom. Also the director clarified that caregivers would not distribute food, and the kitchen manager would provide appropriate alternative snacks for children with known allergies.

746.2805(1) - Prohibited Punishments - Corporal Punishment

When disciplining, a caregiver responded inappropriately by biting a child back after being bitten by the child. The caregivers bite resulted in a swollen black and blue mark on the child's forearm.

746.1201(4) - AP Responsibilities of Employees and Caregivers -Ensure No Child Abused, Neglected, or Exploited

Based on the evidence gathered during the DFPS investigation, it was determined that Physical Abuse was Reason to Believe.
